Lawfare Daily: What the War Powers Resolution Means for Iran

5/11/202659 min

In February, the Trump administration launched Operation Epic Fury in Iran—without congressional approval. The War Powers Resolution is supposed to constrain the president's ability to wage war. But is it?

On today's podcast, Lawfare Executive Editor Natalie Orpett talks with Senior Editor Scott R. Anderson about what that law says, whether it's affecting the administration's conduct, and how—or if—it can be enforced. You can read more of Scott's analysis in Lawfare here: https://www.lawfaremedia.org/article/law-and-the-iran-war--after-the-first-60-days

[music] Hey, it's Katherine Pompilio from Lawfare. You might know me from tracking government non-compliance and habeas corpus cases or running Lawfare's January 6th project. I also work behind the scenes to ensure Lawfare's articles are in tip-top shape. Lawfare is built around one core idea: reliable, independent, non-partisan expert analysis delivered at the pace of news. At a time when trusted institutions are strained, independent, non-partisan analysis plays a critical role. None of our work happens without support from people like you. Lawfare is a nonprofit. We always keep our content free and don't have paywalls, and we rely on our readers and listeners to keep this work going. Become part of our growing Lawfare community, a network of smart, informed people who are invested in understanding the moment, just like you. Head to lawfaremedia.org/support and become a material supporter. Just $10 a month or more, if you're able, really makes a real difference. Plus, you'll help us continue to offer all of our content for free to everyone. Thanks for listening and for caring about the things that matter.

[music] The truth is, all these statutes, and particularly the War Powers Resolution may be a little more vulnerable to this than others, have ... All statutes have kind of require interpretation to be understood. The question is, you know, who gets to interpret and how stable do those interpretations need to be?
